  33.     physical documentation provided with registered versions to be
  34.     free of defects in materials and workmanship for a period of 
  35.     ninety days from the date of registration.  If Applied Analytic
  36.     Systems receives notification within the warranty period of defects
  37.     in materials or workmanship, and such notification is determined to
  38.      be correct, Applied Analytic Systems will replace the defective
  39.      diskette(s) or documentation.

  41.     The entire and exclusive liability and remedy for breach of this
  42.     Limited Warranty shall be limited to replacement of defective
  43.     diskette(s) or documentation and shall not include or extend to
  44.     any claim for or right to recover any other damages, including
  45.     but not limited to, loss of profit, data, or use of the software,
  46.     or special, incidental, or consequential damages or other similar
  47.     claims, even if Applied Analytic Systems has been specifically
  48.     advised of the possibility of such damages.  In no event will
  49.     Applied Analytic Systems' liability for any damages to you or any
  50.      other person ever exceed the lower of suggested list price or 
  51.     actual price paid for the license to use the software, regardless 
  52.     of any form of the claim.
